What is a non-exclusive license?
A non-exclusive license is where you choose an existing design from my portfolio to be manufactured by the printer of your choice, and sold as finished goods in one category. The design may also be licensed non-exclusively to other companies at the same time and will remain for sale on sites such as Spoonflower, where other people may purchase the design printed onto fabric, wallpaper and other products. Cindy Hartmann Design will retain the copyright.

Note: You do not need a license if you make and sell finished goods with fabric purchased from Spoonflower.
EXCLUSIVE
What is an exclusive license?
Usage terms for an exclusive license are negotiated and agreed upon by all parties before any design work commences.
As the designer, I retain the right to use the design during the licensing period for any other purpose not specified in the licensing agreement (for example, if you have exclusively licensed a design in the category of Baby Goods, I may also license the design within a different category such as Wallpaper or Women’s Apparel).
At the end of the term, if you choose not to re-license the design, the right to use the design reverts back to me as the designer.
As the designer, I retain all copyright and ownership of the artwork and all derivative works at all times.

BUYOUT
What is a buyout?
You can choose a design from my portfolio or you can choose a design from my portfolio and I make some changes to it if possible or I make a custom made design for you. But when we agree on the terms and sign the contract, I will transfer all copyright and ownership of the artwork of that specific design to you. But at all times I obtain the right to place images and display our collaboration of the design on my website and social media. If you purchase the design for buyout and it is displayed on Print on Demand platforms like Spoonflower, I will remove the design from that platform.
HOW I WORK?
• Please feel free to contact me and tell me about your pattern idea and requirements or fill in the Licensing enquiry form and I will contact you.
• You can choose a design from my pattern portfolio or commission a custom composition.
• I will give you an estimated quote accordingly for your inquiry.
• We will agree on a licensing contract for the pattern/work required.
• In case we agree on a custom composition: I will send you an invoice for 50% or agreed otherwise.
• I will start working on the project & customizing the pattern for you.
• When the design is completed, you may approve it.
• After the final approval, I will send you an invoice for the rest of the licensing fee. In some cases there are royalties we agreed on.
• I’ll send you the files electronically with the design(s) in the required formats & technical aspects that you need.
• In case you choose a design from my portfolio, I will send you an invoice for the negotiated price and when I receive the full amount I will send you the files electronically.
